Hello

We have just sent off our visa through the STNI route for South australia, since sending the application my husbands occupation has now appeared on the MODL list (motor mechanic)- when our application is being processed are we right in thinking that this will now automatically be changed to an 136 skilled independant? also what are the current timescales - are we likely to have the visa by Easter, considering the Christmas period?

Lesley,

You should receive a letter from your assigned case officer in the next two to four weeks. When you receive that letter I would consider sending an email to him/her quoting your file reference and saying that you would like to be first considered under subclass number 136 given that your husband's occupation is now on the MODL.

If the case officer agrees - and once your visa has been granted - I would let Immigration SA know as a courtesy.

Note that technically one applies for a visa under a particular class (Class BN in the case of the Skilled Independent visas), and that one can then be granted a visa under any subclass that sits within that class (subclasses 136 and 137 are within Class BN, subclass 137 being the Skilled - STNI visa).
