Hi there, I have 2 children from a previous relationship, an 8 yr old boy and a 15yr old girl.My dilema is that although the father see the boy (when he feels like it, when there are no women on the scene) he wont have anything to do with the girl, he just bought a two seater car to make sure of that. His name does not appear on any of the birth certifificates. He has said the girl can go where she like but not the boy, unless i pay him £10,000. Could i do a statortary dec. and take them anyway. we split 5yrs ago im now married with a 2yr old. Any suggestions welcome, he has said if i dont pay for my son to go we have not a leg to stand on.

Hi we had a similar problem with my eldest son. He was from a previous relationship and his father had parental responsibility order for him, which he doesn't very often see him though. We eventually got him to sign a statutory declaration (with the help of his mother) to allow my son to go. Your ex would have to sign the statutory declaration if he agrees then that is all that is required. But i did look into ways we could go about it. I'm pretty sure that if you were not married to your ex and he hasn't applied for parental responsibilities for your son he doesn't actually have any legal stand and you can emigrate without his consent. However if he does have legal rights and he is refusing to sign a statutory declaration then you would have to go to court and get them to consent to your son going, which the courts would more likely rule in your favour as you currently have full custody and there are other siblings involved that would be emigrating to, i don't know how much that would cost though. Its sad when it comes down to money one of the main reasons my ex eventually agreed was so he wouldn't have to pay csa anymore. You should see a solicitor as i would of thought going through the courts could be a lengthy process. Good luck!

Hi thankyou so much for your advice. I will look into it further, like you say it is sad when it comes down to money. Anyway thanks again and fingers crossed.

hi i take it you were never married to your partner who you have the children too, if this is the case we did the same thing spoke to a solicitor did our own stat declaration for 5.00 to say there were no parental responsibility orders or court cases impending, we booked the flights when we got the visa and went said nothing to ex partner and have been here 8 months once your here they cant do anything to make you come back. speak to a solicitor.

THANKYOU SO MUCH FOR YOUR RESPONSE LESLEY. I WAS SERIOUSLY CONSIDERING DOING WHAT YOU DID AS HE WAS REALLY DIGGING HIS FEET IN , BUT LUCKILY HE HAS A NEW GIRLFRIEND AND SHE HAS PERSUADED HIM TO SIGN, SO HOPEFULLY WE COULD BE ON OUR WAY QUICKER THAN WE THOUGHT. THANKYOU AGAIN.

any help i can give is no problem, let me now how things go if you need him to sign and he agrees then great, just be careful once you as him to sign he doesnt then change his mind before you fly. all the best
