Hello all. I am new to this site, so please treat me gently!!
My son and his new wife have been in Oz for a month now. He has started work (permenant visa 136)and his wife is still looking, no children, they are renting at the moment. We want to join them A.S.A.P. and thought we would have to wait 2 years before we could apply. I read an article recently that said they only wanted to see one complete tax year and evidence for the next year that the sponsor (our son) is earning more than $38,000 per year. Can anyone tell me please, when is the earliest we could apply.

Remember also the need for an Assurer to be in place if you apply for a permanent Contributory Parent visa:

In saying this:

- The Assurance of Support is only requested when the application is assessed by a DIAC case officer. For CP visa applications generally this is presently some 12 months after the application was lodged.

- A 2-step pathway to permanent residency is possible under the Contributory Parent program, with the first step being a temporary CP visa. This temporary visa does not require an Assurance of Support.

- I assume the balance of family test is satisfied?

Thank you so much for all the info.
So a month is too soon then!!
If it takes about a year for the A o S to be requested, if we applied after the first year and included as much info as posible, in our application, to show they are 'settled' then by the time it gets to a CO our son will probably have 2 tax years under his belt and have been there 2 years anyway. Is it as simple as that? Probably not.

Please don't confuse the question of the sponsor - your son - having to be settled (this must be the case at the time the visa application is lodged) and the quite separate need for an Assurer to be in place if you lodge an application for the grant of a permanent CP visa.

If you are confused I recommend you contact a competent advisor.

I think it will be better to give Lorraine a ring nearer the time. It sounds so complicated.
Am I right in thinking that my son has to earn over $35,793 (no children and wife working)for the tax year July 08/09 or will it go up for that year as it hasn't started yet?

I recommend you telephone Lorraine for a discussion (023 80 30 2525) so you can clarify the risk areas, and any action that has to be taken in respect of your planned visa application.
