I have accepted a job offer in Sydney and will be relocating from Tokyo. I will be on a 457 visa. My wife will be coming along with me.

How do I determine if I qualify for LAFHA? I checked with the HR person and they do not think I qualify.

Hi Hattori.

I am having the same issue as to whether I am eligible. My Employer thinks I would but I think I am not because I converted from a 417 to a 457 here in Australia.

From all my research I can say that If you accepted the job whilst in your home country - i.e. Usual place of residence, then generally yes you would be entitled.

Likewise if you were employed by your employer in Tokyo and you were transferred to Australia for a short term assignment and had intentions to return home after the assignment ended then yes you probably would be entitled.

Hope this helps but dont take my word for it. LAFHA is such a detailed area.
