Hi
My husband recieves his UK occupational pension into his Aus bank account monthly.
Having filled the forms relating to the tax treaty between UK & Aus and sent them to the ATO, he no longer pays UK tax.
He has a Tax file number in Aus.
He has been told by some advisors that pension income is not taxable in Aus. Others have told him he should be paying double tax (both countries) - we know that is not true. Other has said his income is taxable in Aus.
Could someone clarify this situation please and do we need to get the assistance of a tax advisor? None we have consulted in our local area seem to know - we have had such conflicting advice it is difficult to know who to believe. One of them must be right?

What is your visa/residency status?

The answer to this will determine the correct taxation of your UK source pension income.

Then UK source pension income is wholly taxable in Australia, and should be paid gross in the UK - see the UK-Australia Tax Treaty.

You should not offset UK tax deducted under PAYE from your Australian tax liability.

UK Revenue form FD2 applies.
