Filing UK Tax Return

Moved from UK to Oz 4 years ago on a 457. Before leaving I completed all the necessary UK tax forms informing Inland Revenue that I was no longer going to be resident in UK.

Whilst in Oz I have been completing Oz Tax return as well as a UK tax return on my UK Income. The income is from my UK property being rented out. I have now become a peremanent resident in OZ.

Do I need to continue filing my UK return?

Any advice, recommendations would be greatly appreciated

As long as you continue to have UK income, you will need to lodge a UK return.

Also, check the tax law of the UK, you may be required to include your OZ income on your UK return just as you are required to include your UK income on your OZ return.

Reporting of WORLDWIDE income on returns is becoming the norm with many countries re-writing tax law to make this a requirement.

If HM Revenue continues to issue a Notice to File a Tax Return each year yes, you should continue to complete and submit it - particularly from this year (2011): the reduction in the late filing penalty to nil if no tax is outstanding at 31/01 in relation to the tax year to which the return relates no longer applies.

We usually recommend that those who have no UK tax liability and are being issued with UK tax returns each year should make a request to HM Revenue to close the Self Assessment file.

Remember also that UK rental income was not assessable in Australia while on a 457 visa - but is from the date you are granted permanent residency status.
