Just wanted to know, if you are a temp resident on a 457 visa are you deemed a resident for tax purposes?

Both my husband and I worked on a 457 visa.

My husband was deemed a resident and was tax accordingly, I was taxed as a non resident and taxed higher! Both on the same visa.

According to the tax website, if you live more than 6 months of the year in the country (whether on a temp visa or not) you are deemed a resident for tax purposes.

Any advice would be appreciated.

Sorry guys, just seen another post with the same question.

For the record, if you are on a 457 visa you are deemed a resident for tax purposes.

I ask this question, as it says you are a resident for tax purposes on the tax offices website, however when I lived in Perth previously the deemed my husband a resident and me a non resident, which Im sure is a mistake. Tried several times to get my accountant to correct it, but he never responded.

Anyway, looks like Im due a refund!
